ANC Must Pay – Actress Vatiswa Ndara On Illegal Use Of Her Image


Despite its public apology to Actress Vatiswa Ndara recently, the ANC might still have to pay dearly for using her image without her permission.

The problem started in July when the ruling party used her Igazi character image on its official Instagram account.

On the image were the words; “#Asinavalo”; “Siyanqoba” and “I Vote ANC”. The controversial image was used to promote the party’s Siyanqoba’s rally few days before the August 3 polls.

After all said and done, Ndara expressed her disappointment at the party for not seeking her blessing to use the image. Nevertheless, ANC spokeswoman Khusela Sangoni allegedly said the party had apologised. In addition, the post was immediately pulled down from the account.

Shortly after that, a public apology to the actress was issued by ANC spokesman Zizi Kodwa on Tuesday.

However, Actress Vatiswa Ndara claimed that the ANC had been dodging her for the past two months. Thus, her e-mails to secretary-general Gwede Mantashe; ANC head of elections Nomvula Mokonyane and Sport Minister Fikile Mbalula were ignored.

“They’ve never apologised to me. They even stood me up when I went to a pre-arranged meeting with Zizi and Sangoni at Luthuli House on September 2.

“It’s immaterial to me that they’ve deleted that image. The issue here is that they must pay for using it because my business is my image and they used my image without my knowledge,” Ndara said.

Meanwhile, Sangoni said Ndara had not demanded any compensation. Not that they will oblige the request.

“I don’t know what more we can do because the ANC doesn’t pay artists. If she wants money then she can lodge a case with our legal department,” Sangoni said.

Artists like Riky Rick; Zahara and Thembi Seete allegedly endorsed the ruling party free of charge. But Ndara stressed that she was not given the opportunity to give her consent like the others.

Furthermore, her e-mail to Mantashe and ANC chairwoman Baleka Mbete; Ndara pointed out that she had been threatened with her career if she pursues the matter.

“I’d like to highlight that in pursuing my right, a couple of people warned me that should I do so, the ANC would make sure that all my career doors and opportunities would be shut and that the organisation would make it difficult for me to grow in my career in this country,” she said.

Nevertheless, the actress Vatiswa Ndara seems unfazed by the warnings.
