Replacement Of 3 JSC Members: EFF Roasts President Zuma’s Decision

President Jacob Zuma’s withdrawal of three respected legal brains from the Judicial Service Commission (JSC) has raised the fury of the Economic Freedom Fighters.

On Thursday, the presidency announced that Zuma has replaced Advocate Dumisa Ntsebeza SC, Advocate Ismael Semenya SC and Ms Andiswa Ndoni as members of the Judicial Service Commission.

Zuma also thanked Advocates Dumisa Ntsebeza and Ismael Semenya, who are both senior counsels, as well as Andiswa Ndoni for their indelible contribution to the JSC and their sterling service to the nation,

The president validated his decision by making reference to section 178(3) of the Constitution – which allows members of the JSC to serve until they are replaced by those who designated them.

Touching on the matter, EFF’s Ndlozi slammed the President on Friday for making the announcement without any explanation.

The Fighter alleged that the removal of the 3 JSC members is simply a direct provocation by JSC’s refusal to appoint Advocate (Gcina) Malindi who is an ANC prosecutor into the bench.



Ndlozi, however, lauded the trio, describing them as “seasoned and some of the best minds with integrity in the JSC”.

“Despite it being in Zuma’s powers to remove them‚ it cannot be that this is without any valid explanation. The ANC and Zuma are therefore only trying to have yes men and women in the JSC so that the JSC can appoint judges who can rule in their favour…‚” he said.

The red block party also rejected the president’s recommendation to have Justice Raymond Zondo as the Deputy Chief Justice.

Zuma wants him to take over the position left vacant by the retirement of former deputy chief justice Dikgang Moseneke. Judge Zondo joined the Constitutional Court in 2012 after previously serving as the judge president of the Labour Appeal Court. He was also a judge in the High Court in Pretoria.

“It is inexplicable why Zuma would ignore the acting Deputy Chief Justice Bess Nkabinde who has been serving in the Constitutional Court longer than Justice Zondo.

Above all‚ in the interest of advancing the gender struggle‚ why ignore a woman‚ well-qualified‚ with integrity and who is already acting in the position,” the party asked.
